The agreement between you and R. L. Sanchez for using Binder.

This is the same text Binder shows inside the app, under Settings. Where it refers to a screen or a setting, it means one in the app.

Accepting these terms

By installing or using Binder you agree to these terms. If you do not agree with them, please uninstall the app.

Binder is published by R. L. Sanchez. In these terms, "we" and "us" mean R. L. Sanchez, and "you" means the person using the app.

Your licence to use Binder

We grant you a personal, non-exclusive, non-transferable licence to use Binder on devices you own or control, for as long as you comply with these terms.

You may not sell, rent, sublicense or redistribute the app, and you may not remove or alter any notices contained in it. You may not use Binder for anything unlawful.

What you write is yours

Everything you create in Binder — your notebooks, notes, documents and saved templates — belongs to you. We claim no ownership of it and no licence to it.

We also never see it. It stays on your device: nothing you write in a notebook is ever transmitted, and the Feedback screen sends only what you type into it. You are responsible for what you choose to write and for keeping anything sensitive appropriately protected — your device's own lock screen is what stands between your notes and anyone holding your phone.

Backups are your responsibility

This is the most important thing on this page. Because Binder stores your work only on your device, there is no copy for us to restore. If you uninstall the app, clear its storage, or lose or reset the device, your notebooks are gone.

Android's own backup feature may keep a copy, if you have it switched on, but it is not guaranteed, not controlled by us, and should not be relied on for anything you cannot afford to lose. Keep your own copy of anything important.

Updates and changes

We may release updates that change, add or remove features, and may stop supporting Binder or particular versions of Android at any time. Updates are offered through Google Play; you can decline them, but an old version may stop working correctly.

We may also change these terms. The current text ships with the app, and the date under the title tells you when it last changed.

Third-party services

Binder uses Google Play to distribute and update itself, and Formspree to deliver anything you send from the Feedback screen. Your use of those services is governed by their terms, not ours, and we are not responsible for them.

Do not put anything confidential in a feedback message. It leaves your device and passes through a third party, which is the one thing in Binder that is true of.

No warranty

Binder is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the app will be uninterrupted, error-free, or that any defect will be corrected.

Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for any loss of data, arising from your use of or inability to use Binder.

Nothing in these terms excludes or limits liability that cannot be excluded or limited under the law that applies to you. Some jurisdictions do not allow the exclusions above, in which case they apply to you only as far as that law permits.

Ending this agreement

You may end this agreement at any time by uninstalling Binder. We may end it if you breach these terms. The sections on ownership, warranty and liability survive it ending.

Governing law

These terms are governed by the laws of the Republic of the Philippines, without regard to its conflict-of-law rules.
